Right to Garden Bills Introduced in General Assembly


Both the house and senate have introduced bills in the Illinois General Assembly regarding the "right to garden. If enacted, HB4704 or SB3329 would establish significant prohibitions on the exercise of otherwise broad municipal zoning power regarding gardening activities on residential property. The  bills also include home rule preemption which is pretty rare when legislation involves unique local matters such as zoning. We are actively following these bills and will report back if they appear to be moving forward.
